Itisonthisprinciplethatthemostcelebratedofourwritershaveformallydecidedthatthebribereceivedbyajudgefromoneofthepartieswhohasabadcase,inordertoprocureanunjustdecisioninhisfavour,themoneygotbyasoldierforkillingaman,ortheemolumentsgainedbyinfamouscrimes,maybelegitimatelyretained。
Escobar,whohascollectedthisfromanumberofourauthors,laysdownthisgeneralruleonthepointthat’themeansacquiredbyinfamouscourses,suchasmurder,unjustdecisions,profligacy,&;c。,arelegitimatelypossessed,andnoneareobligedtorestorethem。’
